We would like to inform you that as a customer (consumer), by using the website available at www.ruzgarcosmetic.com, you declare that you are aware of and accept the general terms and conditions of the contract written below, based on Sections 6:77-6:81 of Act V of 2013 (Civil Code). If you wish to be a customer or active user of the opportunities offered by our online store, please read our General Terms and Conditions carefully and only use our services if you agree with all of its provisions and consider them binding for yourself.

This document is concluded solely in electronic form. The contract governed by the following terms is considered a distance contract according to the Civil Code.

The service provider referred to in these general terms and conditions shall hereinafter be referred to as the operator.

2. Range of available products and services

Cosmetic products, professional hair care and skincare products, as well as other products.

Warning: The images displayed on the product data sheet may differ from reality and in certain cases are only for illustrative purposes.

3. Ordering information

The displayed products can only be ordered online through the Webshop, with delivery by courier to the customer's home or personal pickup by the customer or their authorized representative.

The prices displayed for the products include the legally required 27% VAT, but do not include the delivery fee.
The Entrepreneur guarantees the availability of the ordered quantity of products, if they are in stock. In this regard, the Entrepreneur undertakes to deliver the available products from their offering to the Customer, against payment, following the order placed by the Customer, in accordance with the conditions specified in the relevant order confirmation.

If the operator displays an incorrect price next to the product, despite the care expected of them, and the price of the product differs from its generally accepted price, the operator is not obliged to provide the product at the incorrect price, but is obliged to offer the customer the opportunity to purchase at the actual price in the order confirmation. If the customer does not wish to exercise this option, they are entitled to unilaterally withdraw from the contract.

No separate packaging fee will be charged. The detailed shipping rates are part of these terms and conditions, under the Shipping Terms section.

In our online store, you can browse through the available products and services according to product categories. Alongside the listed products, you can view brief descriptions, prices, and other features of each item, without claiming completeness. If you would like to obtain more detailed information about a product, simply click on its image or name. This will direct you to the product page, where you can find more comprehensive information. If you require even more detailed information, please contact the operator using the provided contact number in the operator's details.

Ordering Process

By clicking on the basket icon, you can add the product to your cart. You can add products to your cart without logging in, but before placing an order, you must log in to the system. You can only do this by registering yourself. You can find the registration under the following menu. If you are a registered customer but have forgotten your password, use the Password Reminder for Login. If you provide your registered email address here, we will send you your password via email. You can log in using the Login menu. Enter your registered email address and password, then press the login button. If the login is successful, your registered email address will appear in this window along with the logout button, which you can use to exit the store.

You can check and edit the contents of your cart using the Cart menu. You have the option to view and modify the quantity of the products you wish to order, as well as select your preferred payment and delivery method, and delete specific items. It is also possible to completely empty the cart. If you would like to add additional items to your cart, please select the "continue shopping" button. If everything is in order and you have decided to proceed with the order, you can finalize it by pressing the Checkout button.

Once you have finalized your order, we will send you an automatic confirmation email to the provided email address, which will include the details of your order. If you do not receive such an email, it means that the system did not accept your order. In such cases, please contact us using the provided contact information.

Once we have processed your order, we will send you a Confirmation of Order Closed to the provided email address. The product will be delivered only after this.

You can track the progress of your order until it is closed through the Order Tracking menu. Here you can also find all your previous orders that you have placed on our online store. Each order is identifiable by a unique order number.

4. Registration

If you wish to make a purchase, you must provide the necessary information for the purchase during your first transaction, including your name, billing and shipping details, email address, and the password required for future logins. Acceptance of the registration terms is also required before finalizing the registration. The system confirms the registration via email. The buyer is responsible for keeping their password confidential. If, during the identification process, the buyer's data falls into the possession of an unauthorized third party after correctly providing their unique identifier and password, the Data Controller is not responsible for any resulting damages or disadvantages. By providing their email address, users consent to the operator/service provider sending them technical messages. The operator deletes registered data from the system upon request. For security reasons, the deletion request is only valid if the user confirms the request via email, thus preventing intentional or accidental deletion of other data from the registration database. Registration is identified by the email address, so an email address can only be registered once.

Registration does not entail any obligations.

5. Order Processing

Order processing takes place on weekdays from Monday to Friday, between 12-5 pm. Orders can also be placed outside of the designated processing times, however, if the order is placed after business hours, it will be processed on the following business day. The delivery deadline for accepted orders is 1-4 business days for products in stock in Hungary, starting from the confirmation of the order. In the event that the product is not in stock, the delivery time will depend on the procurement location, ranging from 2-3 weeks.

Our company does not assume responsibility for any technical changes to the ordered product that may occur without prior notice from the supplier or due to external factors beyond our control.

6. The payment method for the ordered product's price and the delivery fee

Please carefully read the following information, as it may not necessarily apply to your specific online store. Adapt the provided instructions to fit the operations of your own webshop.

The payment method for the ordered product

  • Bank Transfer Payment Method: Once we have confirmed your order, you will receive a confirmation email containing our bank account details and the order number to be referenced in the transfer notes/remarks section. We will dispatch the product only after the transferred amount has been credited to our bank account. Our bank account details can be found in the operator information.
  • In-Person Payment Method: In this case, you will pay the product purchase price in cash in Hungarian Forints at the operator's headquarters/branch.
  • Payment by Bank Card is possible for owners of the following valid and effective bank cards: MasterCard, Visa, Amex, Applepay.

The total amount to be paid includes all costs based on the summary of the order and confirmation letter. The invoice is included in the package. Please inspect the package in front of the delivery person upon delivery and, if any damage or missing items are noticed, request a protocol to be recorded and do not accept the package. We are unable to accept any claims without a protocol afterwards.Pricing for Home

Delivery

  • For orders valued between 0-XXX HUF, the fee for home delivery is XXX HUF.
  • For orders valued between XXX-YYY HUF, the fee for home delivery is ZZZ HUF.
  • For residential orders exceeding 25,000 HUF, home delivery is free of charge. (Different regulations apply to our resellers.)
  • In the case of cash on delivery orders, the delivery fee is added to the order value along with the cash on delivery fee.

7. Delivery Time

For products in stock, the delivery time is 1-3 business days from the confirmation of the order. In case the product is not in stock, the delivery time is 1-3 weeks.

8. Home Delivery Information

Orders received by our online store are exclusively delivered by the XXX courier service. Package deliveries are made on weekdays between XXX-XXX hours. It is advisable to provide a delivery address where the courier can be continuously received during the designated time period and ensure the full payment of the shipment value, delivery fee, and cash on delivery fee to the courier.

Only order the desired products if you can pay the courier's fee upon package receipt. In the case of unclaimed or returned packages, the delivery and return fees will be charged to the customer. Resending is only possible upon advance payment of the package value.

9. Information regarding postal delivery

The loss, partial loss, damage, or destruction of a postal item must be reported immediately upon delivery, indicated on the delivery document. Failure to do so will result in the loss of legal rights. In the absence of a delivery document, any other relevant document pertaining to the item must be presented to the postal service within the legal deadline, which is within 2 days from the date of delivery, in order to report the damage promptly.

10. Right of Return

In accordance with Regulation 45/2014 of the government regarding contracts concluded with distant parties, the provisions of this section apply solely to consumers who are purchasers. The consumer has the right to withdraw from the contract without giving any reason within 14 working days from the date of receipt of the ordered product, provided that the product is returned in its original, unopened packaging. If the consumer exercises their right of withdrawal, they must inform the seller in a clear and unambiguous written statement (via email). The seller is obliged to confirm receipt of the withdrawal statement to the consumer without delay. In the event of withdrawal by the consumer, the ordered product must be returned to the seller within 14 days from the date of the withdrawal statement. The cost of returning the product is borne by the consumer. We are unable to refund opened and/or used products. 

If the consumer exercises their right of withdrawal, the seller is obliged to refund all payments made by the consumer within 14 days from the date of receipt of the withdrawal statement. The seller is not obliged to refund until they have received the returned product or have received creditable proof from the consumer that the product has been returned. In case of a discrepancy between the two dates, the seller must take into account the earlier date.

The seller may demand compensation from the consumer for any financial damage resulting from improper use. Therefore, it is important to pay special attention to the proper use of the product, as the consumer is responsible for compensating for any damage caused by improper use.

The returned product is examined upon its arrival at our company to avoid any misunderstandings in the future. For example, to determine if the returned product was damaged or incomplete.

The consumer is not entitled to the right of withdrawal in the following cases:

- In the case of a used and/or opened product.
- In the case of a product whose price depends on uncontrollable fluctuations in the money market.
- In the case of a non-premanufactured product that was specifically produced according to the consumer's request and customized to their specific needs.
- In the case of a product where the seller fulfills the consumer's explicit request for urgent repairs or maintenance work.

 

11. Warranty

The right to warranty does not apply to the buyer if the defect occurred after the product was handed over to the consumer. For products not covered by the designated regulation, the warranty period provided by the manufacturer will be indicated alongside the product. In case of any issues related to this, the seller can provide accurate information. In the case of warranty, the consumer is entitled to free repair or replacement of the defective product within the warranty period. Warranty repairs apply to malfunctions caused by manufacturing defects. The warranty terms are valid in conjunction with the conditions stated in the user manual.

After receiving the goods, the customer is obliged to immediately notify Rüzgar Import & Trade Ltd. in writing of any incorrect deliveries, quantity discrepancies, and deficiencies. The notification must include the delivery note, contract, invoice number, a detailed description of the product, and the specific complaints. Any damages during transportation must be reported immediately after the product arrives at its intended destination. The customer's obligation to inspect the entire shipment applies. The fact and extent of the damage must be recorded on the delivery note/receipt and signed by the carrier. The customer should create a report on the extent of the damage. Despite any possible defects, the goods must be accepted and stored properly. Any hidden defects must be reported within 48 hours of receipt, provided that the product has not been partially or fully used, consumed, or depleted. All complaints must be submitted in writing, including the specific details of each identified defect. The customer must allow the seller the opportunity to inspect the disputed product. If the defect is confirmed, the customer may choose for the seller to rectify the issue or deliver a flawless product in exchange. The seller is not responsible for defects resulting from improper use, storage, or transportation. The seller's warranty obligation, as defined above, only applies if the previously delivered product is returned to the seller in its original, undamaged packaging. The seller will not accept returns of partially or fully used, consumed, or opened packaged products, and such products cannot be subject to warranty claims.

The seller shall not be considered in delay of performance if, in the case of a product not available in stock, the seller informs the Client of this fact, along with the expected delivery deadline, in the confirmation following the placement of the order. In this case, the seller shall not be liable for any compensation.

In all other respects, the provisions of Sections 6.171-173 of the Civil Code shall apply to warranties.

Client's delay: If, within 4 working days after the seller's notification of readiness, the Client is unable to accept or collect the goods, the seller may, at its discretion, either cancel the order in its entirety (and resell the goods) or store the product covered by the order with a storage declaration. If payment was not made at the time of the order or upon receipt, it shall be invoiced. The customer shall bear the storage costs (1,000 HUF/week). With the issuance of the storage declaration, the risk of damage shall pass to the Client. In the event of delayed performance by the Client, the seller may extend its own performance deadline until the other party fulfills its obligations, or, at its discretion, cancel the contract without setting a grace period from the 16th day of delay. By accepting these contractual terms, the parties agree that in the case of a bank transfer payment specified in an individual contract, the seller shall charge the Client a late payment interest rate of 12% from the first day of delay.

12. Warranty Claim

In case of a defect in the delivered product, the buyer has the right to enforce a warranty claim against the operator in accordance with Section 6:159-167 of the Civil Code.

13. Handling Complaints

If you have a complaint regarding the processing of your personal data, please contact us using the contact information provided below. If you are not satisfied with our response to your complaint, depending on your place of residence, you have the right to appeal our decision by contacting us using the contact information provided below, or by submitting your complaint to the local data protection authority.

The operator is obliged to record the complaint in a protocol, at the designated location among the operator's data, and to keep the complaint, together with the response, for a period of five years from the date of recording. The operator is required to examine the received complaint within 30 days from its receipt and provide a substantive response. If the operator provides a rejection response to the complaint, it must be justified in writing. Disputes arising from the contract concluded with the operator should primarily be resolved amicably, through agreement between the parties or before the consumer protection authority competent for the consumer's place of residence. If these methods do not lead to a resolution, the parties may resort to legal proceedings.

14. Data Management

The operator of the online store handles the personal data provided during its use confidentially and does not disclose it to any third party, except in cases where it is necessary for subcontractors (e.g. courier service) to deliver the order.

During the browsing of the online store, technical information is recorded for statistical purposes (IP address, duration of visit, etc.). The operator only discloses this data to authorities in legally justified and substantiated cases. Enabling cookies is necessary to use the service. If you do not wish to allow the use of cookies, you can disable them in your browser settings. Disabling cookies may result in certain elements of the service being partially or completely unusable. A cookie is a file sent by the server to the user's browser and stored on the user's computer. Personal data is not stored in cookies. The data recorded during the ordering process is used by the operator to fulfill the order. The invoice data generated from orders placed on the online store's pages is recorded and stored in accordance with the applicable accounting law. The operator handles the data provided during browsing and registration for newsletter subscriptions confidentially, and unsubscribing can be requested through the provided contact information. You can request the deletion or modification of your data in writing at any time.

The provisions of Act CXII of 2011 are applicable during the order process, and the service provider's data protection statement can be found on the website.

15. Other provisions

In matters not regulated by these general terms and conditions, the provisions of the Civil Code (Act V of 2013) and the Government Decree No. 45/2014 on contracts concluded between consumers and distance contracts shall apply.

16. International users

Please note that your personal data may be transmitted, stored, and processed outside of your country, including the United States. Your personal data may also be processed by employees and third-party service providers and partners in these countries.

If we transfer your personal data outside of Europe, we rely on recognized transfer mechanisms such as the standard contractual clauses issued by the European Commission or any equivalent agreement issued by the competent authority of the United Kingdom, unless the data transfer is to a country that has been determined to provide an adequate level of protection.
